TripTotal terms of use

These terms are the agreement between you and 4Apps for the TripTotal app and the service behind it. Creating an account or using the app accepts them. If you do not accept them, do not use TripTotal.

Who we are

TripTotal is made by 4Apps, a company in Latvia. You can reach us by email at info@4apps.lv.

Your account

You need an account to use TripTotal. Give an email address that reaches you, keep your password to yourself, and tell us if you think someone else has got into your account. One account belongs to one person. TripTotal is not for children under 16.

What TripTotal does

TripTotal records what the people on a trip spend and works out who owes whom. The figures are arithmetic on what you and the other members entered: they are only as right as what was entered, and they are not accounting, tax or legal advice. Paying each other back happens between you and the people you travel with, outside the app. Exchange rates come from the European Central Bank and are a reference, not the rate your bank or your card will charge you.

Trips are shared

Everything you put in a trip is visible to every member of that trip, and any member can add, edit and delete anything in it, including what you entered. There are no roles and no owner. Anyone holding a trip's invite code can join that trip, so give the code only to the people you mean to travel with. When you enter another person's name, or anything else about them, you are the one sharing it.

What you may not do

• Break the law with TripTotal, or use it to harm, harass or impersonate anyone.
• Put in anything you have no right to share.
• Try to reach other accounts, or trips you were not invited to.
• Take the service apart, hammer it with automated requests, or resell access to it.

What you enter stays yours

Your trips, expenses and notes are yours. You give us only what running the service needs: permission to store what you enter and to show it to the members of the trip it belongs to. We claim nothing else in it, we do not sell it, and we do not train anything on it.

The free plan and TripTotal Pro

A free account creates two trips per calendar year. Joining someone else's trip is always free and never counts against that. TripTotal Pro is an auto-renewing subscription of one year that lifts the limit.

You buy it in the app, through the App Store or Google Play, at the price that store shows you before you confirm. It renews for another year at the end of each period unless renewal is turned off at least 24 hours before that period ends, and the store takes the payment within the 24 hours before the renewal. Cancelling is done in your Apple Account settings or in Google Play subscriptions, not inside TripTotal and not by writing to us: neither store lets an app cancel a subscription on your behalf. Cancelling stops the next renewal and leaves the period you have already paid for running to its end.

Apple and Google are the sellers. They take the payment, they hold the card details, we never see them, and a refund is theirs to give under their own terms. If a purchase does not turn into the plan it should have, write to us and we will sort it out.

Trips you created while on Pro stay yours after the plan ends. You go back to two new trips a year.

Changes to the app and the service

We add things, change things and occasionally take things away. We run the service with care, but we do not promise that it is never down, never slow, or works on every device forever. Sync needs a connection: what you enter while the phone has none stays on the phone until it has one again.

Ending it

You can stop whenever you like. Deleting your account in Settings, or on the account deletion page, removes it at once; the privacy policy says what is removed and what stays behind with the trips you shared. Cancel the subscription in the store first, because deleting the account does not cancel it.

We can suspend or close an account that breaks these terms, that is being used to harm someone, or that the law obliges us to stop. Where it is reasonable to do so, we say why first.

Liability

TripTotal is provided as it is. As far as the law allows, we are not liable for a loss that was not a foreseeable result of us breaking these terms, and we are not liable for what you and the people you travel with decide to pay each other. Nothing here limits the liability that cannot be limited: death or personal injury caused by negligence, fraud, and the rights that the consumer law of Latvia and of your own country gives you, which these terms leave untouched.

Changes to these terms

When these terms change we update this page and the date at the top of it. If a change matters to you, the app says so before it takes effect. Using TripTotal afterwards accepts the new version.

Which law applies

Latvian law, and the courts of Latvia. If you are a consumer elsewhere in the European Union you keep the protection of your own country's law and may go to your own courts.

If you use TripTotal on an Apple device

These points are Apple's, and they apply on top of everything above.

• These terms are between you and 4Apps only, not with Apple. 4Apps, not Apple, is solely responsible for TripTotal and everything in it.
• Your licence to use TripTotal is non-transferable and limited to Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
• 4Apps alone provides maintenance and support for TripTotal. Apple has no obligation to provide any.
• 4Apps alone is responsible for any warranty, express or implied, that has not been effectively disclaimed. If TripTotal fails to conform to a warranty that applies, you may tell Apple, and Apple will refund what you paid for the app; to the maximum extent the law allows, Apple has no other warranty obligation whatsoever.
• 4Apps, not Apple, answers a claim by you or by anyone else about TripTotal or your use of it, including product liability, a failure to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
• 4Apps, not Apple, answers a claim that TripTotal infringes someone's intellectual property rights, and is responsible for investigating, defending, settling and discharging it.
• You confirm that you are not in a country under a United States Government embargo or designated by that government as supporting terrorism, and that you are not on any United States Government list of prohibited or restricted parties.
• You keep to the terms of any other agreement that applies when you use TripTotal.
• Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and Apple has the right to enforce them against you as such.
